SCOTUS Vacates Bannon Contempt Conviction, Case Sent Back To Lower Court

The Supreme Court on Monday vacated the contempt-of-Congress conviction against Steve Bannon, sending the case back to a lower court and clearing the way for it to be dismissed. The justices issued a brief order with no written explanation and no noted dissents.

 

The decision wipes away a prior appeals court ruling that had upheld Bannon’s 2022 conviction. It now allows a federal district judge in Washington to consider the Justice Department’s request to dismiss the case entirely,  NBC News reported.

Bannon had already served a four-month prison sentence and paid a $6,500 fine. The charges stemmed from his refusal to comply with a subpoena issued by the House committee investigating the January 6, 2021 Capitol breach.

At the time, Bannon argued he was bound by executive privilege and acted on the advice of his legal counsel. Prosecutors under the prior administration argued that executive privilege did not apply and moved forward with criminal charges.

A jury convicted Bannon in July 2022 on two counts of contempt of Congress. His legal team argued he was not allowed to present a full defense based on his reliance on counsel and privilege claims, but those arguments were rejected in lower courts.

Bannon ultimately served his sentence from July through October 2024. By the time the Supreme Court acted, the penalty had already been carried out.

The Justice Department under President Donald Trump said earlier this year it intended to dismiss the case. Officials described the move as an exercise of prosecutorial discretion and said it was “in the interests of justice,” they said.

The Supreme Court did not directly overturn the conviction itself. Instead, it vacated the appellate ruling and returned the case to the trial court, where the dismissal request can now proceed.

 

 

According to reporting from the Associated Press, the order allows the lower court to consider dismissing both the conviction and the underlying indictment. No justice publicly dissented from the decision.

The case originated from a subpoena issued by the House select committee formed under then-Speaker Nancy Pelosi. The panel investigated the events of January 6 and pursued testimony and documents from several Trump allies.
